§1Who we are and what these terms cover

This website, sonarshop.co.za, is operated by SonarShop, a division of Surgi-Clin (Pty) Ltd (“SonarShop”, “we”, “us”). These terms govern your use of the website and every quotation we issue and order we accept through it. By using the site or requesting a quotation you accept these terms.

§2Use of the website

• You may use the site only for lawful purposes and only to browse our catalogue, request quotations and correspond with us.
• You must be at least 18 years old to request a quotation or place an order.
• You may not attempt to gain unauthorised access to the site, interfere with its operation, or use its content or product data for automated scraping or resale.

§3Quotations — no prices on this site

This website is a catalogue, not a shop. No prices are published on the site and nothing on it constitutes an offer to sell at any particular price. All sales begin with a written quotation from us.

• A quotation is valid for 14 days from its date unless it states otherwise.
• All quotations, product descriptions and specifications are given errors and omissions excepted (E&OE).
• We may withdraw or correct a quotation at any time before you accept it, including where it contains an obvious error.

§4Orders and payment

• A binding order comes into existence only when you accept a quotation in writing and we issue an invoice. Submitting a quote request on this site does not create an order.
• Payment is by electronic funds transfer (EFT) against our invoice. No payments are taken on this website.
• Payment must be received in full before dispatch unless we have agreed other terms with you in writing.
• Goods remain our property until paid for in full.

§5Stock availability

All quotations and orders are subject to stock availability. Refurbished equipment is often a single unit; if an item is sold before your order is confirmed, we will tell you promptly and either source an equivalent, quote an alternative, or refund any amount you have paid.

§6Delivery

Delivery is arranged per order and quoted separately — see our shipping & delivery policy. Delivery estimates are approximate and given in good faith. We are not responsible for delays caused by third-party couriers, customs processing or other events outside our reasonable control, though we will keep you informed and assist in resolving them.

§7Warranty

• Equipment supplied by us carries a 6-month warranty against defects in materials and workmanship, unless the quotation states a different period.
• Spare parts for the equipment we supply are locally available through the Surgi-Clin technical network.
• Technical support is available, and ongoing support is provided with an annual service arrangement.
• The warranty claim procedure and its exclusions are set out in our refund & return policy.
• Nothing in this clause limits the warranties you have under the Consumer Protection Act 68 of 2008 where that Act applies to your purchase.

§8Limitation of liability

To the extent permitted by law, including the Consumer Protection Act 68 of 2008:

• our liability for any claim arising from a sale is limited to the price you paid for the goods concerned;
• we are not liable for indirect or consequential loss, including loss of income or practice downtime;
• we are not liable for loss or damage arising from misuse of equipment, operation by unqualified persons, or failure to follow the manufacturer's instructions for use.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability under section 61 of the Consumer Protection Act.

§9Intellectual property

The content of this website — text, layout, images, logos and product data — belongs to SonarShop or its licensors. Product names and trade marks of equipment manufacturers belong to their respective owners and are used only to identify the goods we supply. You may not reproduce site content for commercial purposes without our written permission.

§10Governing law and disputes

These terms, and every quotation and sale under them, are governed by the law of the Republic of South Africa. Any dispute that we cannot resolve directly with you will be decided by the South African courts. Where the Consumer Protection Act applies, nothing here prevents you from referring a complaint to the National Consumer Commission or another forum that Act provides.

§11Changes to these terms

We may revise these terms from time to time. The version published on this page at the date of your quotation applies to that transaction. This document is Rev 0.1 and is a draft pending review by the company's legal adviser.
